3. Quotes and Estimates
3.1 Free Consultation
We offer free, no-obligation consultations and estimates for all remodeling projects. Estimates are provided in writing and are valid for 30 days from the date of issue unless otherwise stated.
3.2 Estimate Accuracy
Estimates are based on the information provided by the customer and our initial assessment. Final project costs may vary if:
- Unforeseen conditions are discovered (e.g., structural issues, hidden damage)
- Customer requests changes or upgrades to the original scope of work
- Material prices increase between estimate and project start
- Additional permits or inspections are required
We will notify you immediately of any cost changes and obtain your approval before proceeding with additional work.
3.3 Written Contract Required
In accordance with New Jersey Home Improvement Contractor Registration Act (N.J.S.A. 56:8-136 et seq.), all projects over $500 require a written contract signed by both parties before work begins.
4. Payment Terms
4.1 Payment Schedule
Payment is typically structured as follows:
- Deposit: Up to 1/3 of the total contract price upon signing (as permitted by NJ law)
- Progress Payments: Based on project milestones (materials delivered, work completed)
- Final Payment: Due upon substantial completion and customer approval
Note: New Jersey law (N.J.S.A. 56:8-136) prohibits contractors from requiring more than one-third of the contract price as a down payment.
4.2 Accepted Payment Methods

- Check (payable to Custom Kitchens & Baths by Lopez)
- Credit/Debit Cards (processing fees may apply)
- Bank Transfer/Wire Transfer
- Financing (subject to credit approval through our lending partners)
4.3 Late Payments
Late payments may result in:
- Work stoppage until payment is received
- Late fees (as permitted by law and specified in contract)
- Cancellation of contract (with return of materials/work to pre-project state)
5. Project Timeline
Project timelines are estimates and may be affected by:
- Weather conditions
- Material availability and delivery delays
- Permit approval times
- Unforeseen structural or system issues
- Customer-requested changes
- Inspection scheduling
We will communicate any timeline changes promptly and work diligently to minimize delays.
6. Changes and Modifications
Any changes to the original scope of work must:
- Be requested in writing or confirmed in writing
- Include a written change order with updated pricing and timeline
- Be signed by both parties before work proceeds
Verbal changes may not be honored without written confirmation.
7. Warranties and Guarantees
7.1 Workmanship Warranty
We warrant our workmanship for a period of one (1) year from the date of project completion. This warranty covers defects in installation and construction.
7.2 Material Warranties
Materials are covered by the manufacturer's warranty. Warranty terms vary by product. We will provide warranty documentation for all materials installed.
7.3 Warranty Exclusions
Warranties do not cover:
- Normal wear and tear
- Damage caused by misuse, abuse, or neglect
- Damage from accidents, natural disasters, or acts of God
- Modifications made by others after project completion
- Failure to perform recommended maintenance
8. Customer Responsibilities
As the customer, you agree to:
- Provide accurate information about the project scope and requirements
- Ensure access to the work area during scheduled work hours
- Remove personal belongings and valuables from work areas
- Secure pets during work hours
- Notify us immediately of any concerns or issues
- Make timely payments according to the agreed schedule
- Obtain HOA or condo association approvals if required
- Maintain insurance on your property (homeowner's insurance)
9. Insurance and Liability
9.1 Our Insurance
Custom Kitchens & Baths by Lopez maintains:
- General Liability Insurance
- Workers' Compensation Insurance (as required by NJ law)
Proof of insurance is available upon request.
9.2 Limitation of Liability
Our liability is limited to the contract price. We are not liable for:
- Consequential damages (e.g., loss of use, alternative housing costs)
- Pre-existing conditions not disclosed or discoverable during initial assessment
- Damage to concealed utilities not marked or disclosed
- Changes in property value
10. Permits and Inspections
We will:
- Obtain all required building permits (costs included in contract or as add-on)
- Schedule required inspections
- Ensure work complies with New Jersey building codes
- Provide copies of permits and inspection certificates
Permit fees are typically the customer's responsibility unless otherwise stated in the contract.
11. Cancellation and Termination
11.1 Three-Day Right to Cancel
Under New Jersey Home Improvement Practices Regulations (N.J.A.C. 13:45A-16.2), you have the right to cancel any home improvement contract within three (3) business days of signing, without penalty. Cancellation must be in writing and delivered to our business address.
11.2 Cancellation After Three Days
After the three-day period, either party may terminate the contract for cause (breach of terms). If you cancel after work has begun, you will be charged for:
- Work completed to date
- Materials ordered or delivered
- Non-refundable permit fees
- Reasonable costs incurred
12. Dispute Resolution
In the event of a dispute:
- We encourage direct communication to resolve issues amicably
- If unresolved, mediation through a neutral third party may be pursued
- Disputes may be submitted to the New Jersey Division of Consumer Affairs for resolution
- Legal action may be pursued in New Jersey courts as a last resort

13. Intellectual Property
All design plans, drawings, and concepts created by Custom Kitchens & Baths by Lopez remain our intellectual property. You receive a license to use these designs for your specific project only.
We may use photos and descriptions of completed projects for marketing purposes unless you request otherwise in writing.
14. Website Use
By using our website, you agree to:
- Use the site for lawful purposes only
- Not attempt to hack, disrupt, or damage the site
- Not submit false or misleading information
- Not infringe on intellectual property rights
- Comply with all applicable laws and regulations
We reserve the right to deny service or access to anyone for any reason.
