These Terms of Service (“Terms”) govern your use of the Custom Kitchens & Baths by Lopez website (https://www.customkitchensbylopez.co) and any remodeling services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms.

2. Services Offered

We provide kitchen remodeling, bathroom remodeling, custom cabinetry, countertop installation, tile work, flooring, plumbing and electrical (via licensed subcontractors), design consultation, and general home improvements. All work complies with New Jersey state and local building codes.

3. Quotes and Estimates

Free, no-obligation consultations are available for all projects. Estimates are provided in writing and valid for 30 days unless otherwise stated. Final costs may vary due to unforeseen conditions, customer-requested changes, or material price changes. We notify you and obtain approval before any additional work proceeds.

Per the NJ Home Improvement Contractor Registration Act (N.J.S.A. 56:8-136), all projects over $500 require a signed written contract before work begins.

4. Payment Terms

Payment is structured as: a deposit of up to 1/3 of the total contract price upon signing (as permitted by NJ law), progress payments tied to project milestones, and final payment upon substantial completion.

Accepted methods: cash, check, credit/debit card (fees may apply), bank transfer, and financing subject to credit approval. Late payments may result in work stoppage or late fees as specified in your contract.

5. Project Timeline

Timelines are estimates and may be affected by weather, material availability, permit approvals, unforeseen conditions, customer-requested changes, or inspection scheduling. We communicate all timeline changes promptly.

6. Changes and Modifications

Any scope changes must be requested in writing, documented in a signed change order with updated pricing and timeline, and approved by both parties before work proceeds. Verbal changes are not honored without written confirmation.

7. Warranties and Guarantees

We warrant our workmanship for one (1) year from project completion. Materials are covered by manufacturer warranties, documentation provided at completion. Standard warranty exclusions apply: normal wear and tear, misuse, accidents, natural disasters, modifications by others, and failure to maintain.

8. Customer Responsibilities

Customers agree to provide accurate project information, ensure work area access during scheduled hours, remove valuables from work areas, secure pets, notify us of concerns immediately, make timely payments, obtain HOA approvals if required, and maintain homeowner's insurance.

9. Insurance and Liability

We carry general liability insurance and workers' compensation as required by NJ law. Proof available upon request. Our liability is limited to the contract price. We are not liable for consequential damages, pre-existing conditions not disclosed during assessment, or concealed utilities not marked.

10. Permits and Inspections

We obtain all required building permits, schedule required inspections, ensure code compliance, and provide copies of permits and inspection certificates. Permit fees are typically the customer's responsibility unless stated otherwise in the contract.

11. Cancellation and Termination

Under NJ Home Improvement Practices Regulations (N.J.A.C. 13:45A-16.2), you have 3 business days from signing to cancel without penalty. After that period, if you cancel after work has begun, you will be charged for work completed, materials ordered, non-refundable permit fees, and reasonable costs incurred.

12. Dispute Resolution

We encourage direct communication first. Unresolved disputes may be submitted to the NJ Division of Consumer Affairs (1-800-242-5846) or the Better Business Bureau. Legal action in NJ courts is a last resort.

13. Intellectual Property

All design plans and concepts remain our intellectual property. You receive a license for your specific project only. We may use project photos for marketing unless you request otherwise in writing.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey. Legal actions shall be brought in the courts of New Jersey.
